This policy outlines your rights to cancel an order and return goods purchased from RainGardens.co.uk.
1. Under the Consumer Contracts Regulations, you may cancel your Order at any time from the point of placing it up to fourteen days after the day you receive the Goods.
2. Where the Goods are purchased for purposes connected with your trade, business or profession and you are not acting as a consumer, clause 1 does not apply. In these circumstances, cancellation is only permitted in accordance with clause 5.
3. If you cancel your Order after the Goods have been dispatched, you will be responsible for the cost of returning the Goods to RainGardens.co.uk.
4. If you cancel your Order and wish to return the Goods under this clause, the following conditions apply:
a) to cancel your Order, please contact RainGardens.co.uk in writing by email or post using the contact details provided on the website;
b) to help us improve our service, we may ask for the reason for the return;
c) Goods must be returned complete, unused and in an undamaged condition;
d) once we have received notice of cancellation, we will refund any amounts paid for the Goods as soon as reasonably possible and, in any event, within fourteen days of receiving your notice, provided the Goods are returned and received by us in the same condition as when they were delivered. If the Goods are not returned or the return costs are not paid, we reserve the right to deduct the direct cost of recovering the Goods from any refund due.
PLEASE NOTE THAT THE RIGHT TO CANCEL YOUR ORDER UNDER CLAUSE 1 DOES NOT APPLY TO TURF OR OTHER PERISHABLE GOODS THAT ARE LIABLE TO DETERIORATE RAPIDLY ONCE PREPARED, HARVESTED OR DISPATCHED IN FULFILMENT OF YOUR ORDER.
5. If you wish to return Goods because they do not comply with these Conditions, your statutory rights, or because RainGardens.co.uk has supplied incorrect Goods, you should contact us using the details referred to in clause 4(a) within a reasonable time of discovering the issue. Where a return has been agreed at RainGardens.co.uk’s expense, you may request replacement Goods or a refund of any sums paid for the Goods within fourteen days.
6. Your rights under clause 5 do not apply where only the packaging has been damaged during transit and the Goods themselves remain unaffected.
For the purposes of these Conditions, any reference to “Turf” shall include all products listed within the Turf category on the RainGardens.co.uk website, including, but not limited to, lawn turf, wildflower turf, sedum turf and any other turf products offered for sale.
7. Turf is highly perishable and, if not laid promptly in accordance with the instructions provided by RainGardens.co.uk, may deteriorate rapidly. Where Turf is not rolled out immediately in spring/summer and within 24 hours in autumn/winter (or within such other timescale as advised by RainGardens.co.uk), RainGardens.co.uk will not accept responsibility for such deterioration and will not accept a return of the Turf arising from that deterioration. Other living or perishable products supplied by RainGardens.co.uk should also be installed, planted or used promptly in accordance with the guidance provided. It is therefore your responsibility to ensure that you are able to receive and use the Goods appropriately before agreeing a delivery date.
8. You should also be aware that the ongoing condition of Turf and other natural or living products supplied by RainGardens.co.uk may be affected by factors beyond our control, including (without limitation) weather conditions, growing conditions, environmental factors, or unintended blown or animal/bird carried seeding. The condition of such Goods will also depend on the care provided following delivery. Whilst RainGardens.co.uk shall be liable for any failure of the Goods to comply with these Conditions or your statutory rights at the time of supply, you will not be entitled to return Turf or other natural or living products because of defects arising after delivery, whether due to a failure to follow the guidance provided by RainGardens.co.uk or as a result of external factors beyond our control.
9. If you exercise your right to cancel your Order in accordance with clause 4(a), RainGardens.co.uk will refund any sums paid by you for the Goods within fourteen days of you notifying RainGardens.co.uk that your Order has been cancelled.
10. Where deliveries cannot be made due to insufficient access to the delivery address, difficulties on the approach to the address, an unsuitable unloading area, obstructions, or where incorrect or insufficient delivery instructions have been provided, a charge of £30 (inc. VAT) per pallet will be made for redelivery or return delivery to RainGardens.co.uk*. Payments made for additional delivery options such as Express Delivery or a timed delivery slot will not be refunded.
*Fees must be paid prior to an order being released for redelivery. If the order is returned to RainGardens.co.uk, the £30 charge per pallet will be deducted from any outstanding refund due. Due to the perishable nature of Turf and certain other products, where delivery cannot be made successfully we may be unable to refund the amount paid for those Goods.
